Özet
ÖZET Ülkemizin en aktif deprem kuşaklarından birisi olan Akdeniz Himalaya deprem kuşağında yer alması 1.2.3.4.5 deprem kuşaklarının ülkemizin % 98 ini kapsaması ve 17 Ağustos 1999 da Marmara depremi olarak literatüre giren bu yıkım olayından ülkenin içinde bulunduğu deprem kuşaklarından ve genel afetler konusundan hareketle, genel anlamda, kentleşme, planlama ve konut konularında ülkemizdeki afetler mevzuatının ve mevzuatın aksayan yönlerini incelemek gerekmektedir. Çağdaş afet yönetimi ve doğal afetlerle mücadelede her şeyden önce tabiattaki mevcut tehlikelerin iyi bilinmesi ve bu tehlikelerin doğurabileceği riskleri azaltmak için tabiatın en akılcı yol ve yöntemlerle kullanılmasını gerektiren ve hatta zorunlu kılan topyekün bir mücadeledir. Bu mücadele içerisinde en sade vatandaştan en yetkili makamlara kadar herkese görev ve sorumluluk düşmektedir. Öncelikle doğal afet zararlarının ancak, doğal afetler meydana gelmeden alınacak yasal, idari ve teknik önlemlerle azaltılabileceğine her kademede inanmak, her zaman hazırlıklı olmak ve uygulanacak afet yönetim sistemini buna göre düzenlemek gerekmektedir. Ülkemizde afet yönetimi konusunda daha ziyade afet olduktan sonra yara sarmak politikası şeklinde bir uygulama söz konusudur. Ayrıca hem afet öncesi ve hem afet sonrası bir çok sorun ortaya çıkmakta ve bu sorunların çözümünde mülki idare amirlerini yetkileri özellikle planlama, imar mevzuatı uygulamaları, yapılaşma ve yapı kontrollerinde sorunlar söz konusu olmaktadır. Bu konuda ön görülen; yetkilerin yerel yönetimlere bırakılması özerk kurumlara bırakılması görüşlerinin yerine bu konuda eğitimli, Devleti her yönüyle tanıyan mülki idare amirlerine yetki ve sorumluklarının tevcih problemin çözümü için etkili olacaktır.

ABSTRACT Our country is in the one of the most active earthquake zones whics is Hymalaia-Mediterranean one. The first five grades of the earthquake zones compromise 98 per cent of the Turkey. Especially, Marmara Earthquake, in 17 August 1999, is so important that it is a key for us to make evaluation about disaster law and its deficiencies with respect to urbanisation, planning and housing. In the contemporary disaster management and dealing with the natural disasters we have to know existing dangers and to reduce the risks of these it requires the using of nature with the most rational ways and methods even it is a total fight. In this context, everybody has a duty and responsibility from citizens to the officials. To be successful in the fighting with the natural disasters we have to believe the importance of taking legal, administrative and technical measures at all level before disasters. This point is also the essence of the natural disaster management and it is required to regulate according to this esence. In practice the curing policy is more common after a disaster. Additionally, some problems occur before and after the disaster. In this context, the solution of these problems and the authorities of the governors at the provincial level is a case particularly for planning, housing, construction and controlling of the construction. It is envisaged that the devolution of the authorities and responsibilities to governors is more effective than to local government and indenependent bodies.
