Özet
KADINLARIN HUKUKİ VE SOSYAL STATÜLERİNE İLİŞKİN HADİSLER (KÜTÜB-İ SİTTE'DE) ÖZET Biz bu çalışmamızda Kütüb-i Sitte kapsamında kadınların hukuki ve sosyal statülerine ilişkin bazı hadisleri tahric edip, metin ve sened değerlendirmesine tabi tuttuk. Bizim araştırmamızın amacı; sınırını belirlediğimiz konular kapsamında, kadının hukuki ve sosyal statüsüne ilişkin Hz. Peygamber (a.s)in sözlerini ve uygulamalarım Kütüb-i Sitte' den tahric ederek kadınla ilgili konularda hadis çerçeveli çalışma yapanlara da yön gösterme babında bu hadislerin sened ve metin değerlendirmesinin yapılış şeklini ortaya koymaktır. Araştırmamız hadis kapsamlı olduğu için, önce kadınla ilgili hadislerin seçimini yaptık. Sonra hadisleri gruplara ayırarak ilgili oldukları konulara göre sıraladık. Ele aldığımız hadisleri verdikten sonra, hadislerin metin farklılıklarım belirttik. Sened değerlendirmesiyle hadislerin sıhhatini ortaya koyduktan sonra da genel bir değerlendirme yaptık.. Değerlendirmeye aldığımız hadislerden yola çıkarak şu sonuca vardık: Kütüb-i Sitte'de kadınların hukuki ve sosyal durumlarıyla ilgili, hadis literatürü açısından sıhhat değerleri farklı olan, ayrıca bir birbirlerine muhalif görünen hadisler mevcuttur. Hem Kütüb-i Sitte kaynaklı hem de diğer hadis literatürlerine dayanılarak yapılan kadın hususundaki çalışmalarda sıhhatli bir sonuca ulaşmak için, öncelikle ortada olan bir rivayetin varolan bütün varyantlarına ulaşmak, sonra da bu rivayetleri söylendikleri ve uygulandıkları zamana göre değerlendirmek gerekmektedir. Kütüb-i Sitte'de kadınlarla ilgili bazı hadisler tahric edildi. Kadınlarla ilgili sıhhat değerleri farklı olan hadislere ulaşıldı. Ele alman hadislerle Hz. THE HADITH ABOUT THE WOMEN'S JURIDICAL AND SOCIAL STATUS ( KUTUB AL- SİTTA ) ABSTRACT Hereby, in our studies, we have examined some of the hadith sentences related with the juridical and social statutes of the women in the contest of Kutub al- Sitta and we have been supplied to the evaluation of text and document. Our goal is, in the contest of the subjects that we determined the borders, to introduce the way of the evaluation of text and document to the person who study about juridical and social statutes of the women in Kutub al- Sitta an the speechs Of Hz. Mohammed (a.s). Mohammed (a.s) Our researchment is related with hadith sentences, first of all we have chosen the Hadith senteneces related with women. After than by seperating the hadith sentences into the groups to set up in the order according to the related subjects. After given up the hadith sentences we studied, we determined the text dfferences of the hadith sentences we made the general evaluation. We drawn a conclusion according to the hadith sentences we studied on as follows; İn Kutub al- Sitta, related with the juridical and social statutes of the women, in the contest of Hadith sentences literature there are some different hadith sentences and also there are some opposing hadith sentences to each other. İn Kutub al- Sitta some of the hadith sentences related with the women have been examined. Some hadith sentences have been find related with the women which their safetyt are different each other.
