Özet

Rusya Federasyonu Siyasal Sistemi olarak adlandırılan bu çalışma, üç bölümden oluşmaktadır. Çalışmanın genel çerçevesini, Sovyetler Birliği'nin dağılmasından sonra Rusya'da gerçekleşen anayasa yapımı ve 1993 tarihli Rus anayasasının öngördüğü hükümet sistemi oluşturmaktadır. Çalışmanın birinci bölümünde; genel olarak, hükümet sistemlerinin tanımı ve özellikleri belirlenmiş ve hükümet sistemlerinin siyasal yaşama etkileri ile ilgili literatürdeki tartışmalar aktarılmıştır. İkinci bölümde; SSCB'nin kurulmasından önceki dönemde Rus siyasal yaşamına etki eden olaylar tarihi açıdan incelenmiş; SSCB'nin kurulmasından sonraki dönemde ise Sovyet anayasalarının öngördüğü devlet biçimi ve siyasal organlar ele alınmış ve siyasi uygulamalara ayrı bir başlık altında değinilmiş, Glastnost ve Perestroyka dönemlerinin hükümet sistemine ve siyasi uygulamalara etkileri ve SSCB'nin yıkılması da incelendikten sonra son olarak Rusya Federasyonu'ndaki SSCB sonrası kısa Komünist dönemdeki hükümet sistemi ve anayasa yapım süreci ele alınmıştır. Çalışmanın son ve temel kısmını oluşturan üçüncü bölümde ise, şu an yürürlükte olan 1993 tarihli Rusya Federasyonu anayasasının öngördüğü üzere; Rusya Federasyonu federal yapısı yasama ve yürütme organlarının yapıları, yetkileri ve birbirleriyle olan ilişkileri incelenmiş. Anayasal düzenlemelerin siyasi yaşama etkileri ise siyasi partiler, somut olaylar, anayasa mahkemesi kararları ışığında değerlendirilmeye çalışılmıştır.

This LLM dissertation, which consists of three chapters, is a research about constitutional design and its political outcomes in Post-Communist Russia; therefore the constitution making in Russian Federation after the collapse of Soviet Union and the government type that the 1993 constitution creates, constitutes the framework of this study. In the first chapter; the typology of the government types are examined and the arguments concerning the political outcomes of the constitutional and institutional choices, concerning the government types, from the literature are quoted. The second chapter includes; the examination of, the events that are considered to be milestones in the Russian political history, political system of USSR in theory and practice, the period of Glastnost and Prestroika and the collapse of Soviet Union from the point of constitutional and political changes. Also in this chapter; the constitutional making in the Russian Federation in the two year period of Post-Soviet Communist Russia is studied with its legal and political aspects. Finally in the third chapter; the contemporary federal structure and the government type as prescribed by the Russian Constitution in force, is examined both in theory and practice. Hence, this chapter comprises; Concept of Russian Federalism; central- provincial relations, the structures and the constitutional powers of the legislative and executive organs, executive-legislative relations, party system, and overall description of the Russian Political System.
