126 SUMMARY Professional player transfer agreement is a process which is obliged mutual debts to parties. In the professional player transfer agreement, one part's obligation is to turn over the recommendation right or competence from the right. The other part's obligation is fulfillment the substance value. Players who have received remuneration for activity connected with association football are regarded as professional. The parties of professional player transfer agreement can be only association or company. Professional player transfer agreement has three kinds. Transfer permanent agreement is the first kind. The second kind is temporary transfer agreement. Another kind is mutual transfer agreement. If there is a transfer permanent agreement between parties, former club turns over the recommendation right. In the temporary transfer agreement, former club turnsover the competence from the right. When the temporary transfer agreement terminates, player turns to former club. In addition to this two player's recommendation rights are subject of mutual transfer agreement. The main element of professional player transfer agreement is recommendation right. A football club has recommendation right because of player's education, training and presentation. If the recommendation right is not defined from the national association and FIFA, former club can not demand recommedation and transfer fee. It has also been argued that recommendation and transfer fees are necessary to safeguard the worldwide organization of football. If parties conclude transfer permanent agreement, new club's obligation is recommendation fee. When parties conclude temporary transfer agreement, new club's obligation is transfer fee.
