oz idarenin denetlenmesi ve ombudsman sistemi Mutta, Serdar Yüksek Lisans Tezi Kamu Hukuku Ana Bilim Dalı Tez Danışmanı: Prof. Dr. Burhan KUZU Kasım 2001, 141 Sayfa Bu tez çalışmasının amacı, idarenin etkin ve verimli bir şekilde nasıl denetleneceğinin saptanmasıdır. İdarenin denetlenmesi ve ombudsman sistemi üç bölümde incelenmiştir. Birinci bölümde; 1- Modern bürokrasilerin doğuşu ve bürokrasinin, bürokratizme dönüşmesi, 2- İdarenin denetlenebilmesi açısından devlet anlayışındaki farklılıklar, İkinci bölümde; 1- İdarenin denetlenmesi zorunluluğu, 2-İdarenin denetlenmesi şekilleri ve bu denetim mekanizmalarının yetersizlikleri, Üçüncü bölümde; 1- Ombudsman sisteminin özellikleri, 2- Ombudsman sisteminin değişik ülkelerde uygulama biçimleri, 3- Ombudsman sistemi ve Türkiye'deki tartışmalar, 4- Türk Ombudsman! 'nda bulunması gereken nitelikler, İdarenin etkin ve verimli bir şekilde denetlenebilmesi için mevcut denetim mekanizmalarının yanında ombudsman sisteminin Türkiye'de kurulmasının faydalı, hatta zorunlu olduğu sonucuna varılmıştır. Ayrıca Türk Ombudsmam'nın kurulusu sırasındaki dikkat edilecek hususlara ve Türk Ombudsmam'nın taşıması gereken özelliklerine yer verilmiştir. II

ABSTRACT THE CONTROL OF ADMINISTRATION AND THE SYSTEM OF OMBUDSMAN Mutta, Serdar M.Sc, Department of Public Administration Supervisor: Prof. Dr. Burhan Kuzu November 2001, 141 pages The aim of this study is to determine how to control* administration productively and actively. The control of administration and the system of ombudsman are examined under three titles. In first title; 1-The appearance of modern bureaucracies and evoluation of bureaucracy in to bureaucratism, 2-The differences in government mentality from the aspect of control of administration, In second title; 1-The obligation of control of administration, 2-The methods of control of administration and insufficiency of these methods, In third title; 1-The properties of system of ombudsman, 2-The different applications of system of ombudsman in different countries, 3-The system of ombudsman and disputes over the system of ombudsman, 4-Properties that Turkish ombudsman must have, It is concluded that foundation of system of ombudsman in Turkey, besides current control mechanisms,is useful, even obligatory in order to control administration productively and actively. In addition to that, during foundation of Turkish Ombudsman, points to be cared and properties that Turkish Ombudsman must have, are explained widely.
