Özet
ÖZET Kavramlar var olanı çerçevelendirmeye, sınırlarının çizmeye çalışır. Felsefe de olup biteni temel nitelikleriyle çerçevelendirmeye çalışan bir etkinliktir. Kavramların anlamlarının göreli olduğu anlayışının yanı sıra, adalet söz konusu olduğunda, adaletin de ortak olarak temellendirilemeyen istemlere bağlı olduğunu ileri suren anlayışlar öteden beri mevcuttur. Bu çalışmada adalet kavramından önce“kavram kavramı”felsefi açıdan ele alındı.“Kavram kavramı”na ilişkin temellendirmeler yapılırken, yapılan temellendirmeler“adalet”kavramıyla ilişkilendirilmiştir. Ayrıca“adalet”kavramıyla doğrudan ilişki içinde olan“hak”,“insan değeri”,“insan hakları”,“hukuk”,“eşitlik”,“özgürlük”,“sivil itaatsizlik”kavramlarının“adalet”kavramıyla ilişkisi belirlenmeye çalışıldı. Birinci bölümde ortaya konan düşünceler, insanın olanaklar potansiyelleri olduğu görüşünü temel almakta, nominalist bir varlık anlayışından hareketle her olup biteni kendi tek tekliği ki içinde çözümlemenin gerekliliği üzerinde durulmakta. İnsan ilişkilerinde adalet her durumun, kendi tekliğinde, doğru değerlendirilmesi sonucunda verilecek kararla, yapılacak eylemle sağlanabilir. Yapılan eylem, verilen karar“insan değeri”ni,“yaşama hakkı”nı koruduğu sürece adalet istemine uygun bir karar, bir eylem olacaktır. Hiçbir kavram felsefede, bir anda ortaya çıkmamıştır. Bu nedenle çalışmanın ikinci bölümünde“adalet”kavramının belli başlı filozoflar tarafından nasıl ele alındığı, sofistlerden günümüze kadar nasıl ele alındığı, filozoflardan yapılan özetlemelerle ele alınmıştır. SUMMARY Concepts try to focus the limit and to determine the things that exist. Also philosophy is an activity which tries to frame the things that happen with its basic qualities. Beyond the understanding of the relativity of the meanings of the concepts, when justice has been considered, some point of views which support that justice, too, has been connected to some volitions that connot be based in common, have been existing for a long time. In this piece of work, before the conception of justice,“the conception of concept”is taken by the means of philosophy. When the basement that is connected to“the conception of concept”is being done, the basements that have been done, have been connected with the conception of“justice”. Also, the concepts of“the right”,“the value of human being”,“human rights”,“justice”,“equity”,“freedom”,“disobedience of civilian”which are directly related to the concept of“justice”, were tried to be determined the relation with the concept of“justice”. In the first part, the ideas which occur, base the conception of the potentials which the human have and also it's emphasized that the necessity of solving all the thing by self that happen by the means of nominalist existence. In relationships justice can be obtained by the decision which will be taken from the result of well evaluation by şelfin all situations and the action which will be done. The action which has been done, the decision which has been taken, will be a suitable decision or an action as long as it protects the“value of human being”,“the right of living”. None of the concepts in philosophy occur instantolly. For this reason in the second part of the work, the way of giving the conception of justice by the main philosophers, the way of taking it from the time of the sofistis upto date, are given by the help of the summaries which are dene by the philosophers.
