Özet

David Hume'un felsefesinin etkisinin günümüze kadar ulaşması, filozofun ele aldığı konuların güncelliğini yitirmeyecek nitelikte oluşundan kaynaklanmaktadır. Filozofun içinde bulunduğu görgücü (empricist) felsefe geleneği dışındaki okulları da etkilemiş olması, bunun göstergesi sayılabilir. Bu doğrultuda, neden ile sonuç arasında zorunlu bir bağın bulunduğunun ussal ya da görgül yollardan kanıtlanamayacağını deyimleyen Hume Çatalı (Hume's Fork), filozofun en önemli vargılarından biri olarak görülmektedir. Hume'un epistemolojiye yaptığı bu önemli katkının yanında Hume Yasası (Hume's Law) olarak bilinen“olandan olması gerekene çıkarım yapılamayacağı”vargısı, aksiyolojinin her alanında gözetilmesi gereken bir ilke olarak benimsenmiş, bu ilkeye getirilen başkaca yorumlar kimi kuramların temelinde yer almıştır. Bu durum hukuk felsefesi için de geçerlidir. Böylece hukuk felsefesi kuramlarında bir temel ya da tutarlılık ölçütü olarak benimsenen Hume Yasası'nın, kuramsal anlamda ilgiye değer bir yönünün bulunduğu söylenebilir. Hume Yasası'nın belirttiği öne sürülen olgu ile değer arasında, olan ile olması gereken arasında kapatılamaz bir boşluk olduğu vargısına karşı çağdaş felsefecilerce çeşitli savlar öne sürülmüştür. Bunlardan en bilineni Alasdair Chalmers MacIntyre'ın öne sürdüğü ve bizim Hume Sınaması olarak adlandırılmasını benimsediğimiz savdır. Buna göre Hume, olandan olması gerekenin hiçbir biçimde çıkarılamayacağını öne sürmemiştir. Nitekim filozofun kendi felsefesinde böyle bir geçişte bulunduğuna örnekler veren MacIntyre'a göre Hume'un ortaya koyduğu, olandan olması gerekene geçişin olanaksızlığı değil güçlüğüdür. Bu anlayışın geliştirilmesinden sonra ortaya çıkan tartışmalar sonucunda Hume Yasası'nın önceden sanıldığı kadar sarsılmaz olmadığı ortaya konmuştur. Buna karşın çağdaş hukuk felsefesinde Hume Yasası neredeyse“verili”özellikte sayılmakta, genel olarak bir tutarlılık ölçütü diye kuramsal tartışmalarda öne sürülmekte ve gözetilmektedir. Bu durum, çalışmamızın odağına aldığımız sorunları doğurmakta, Hume'un getirdiği bir ilke olarak olan-olması gereken ayrılığının hukuk felsefesinde nasıl kavrandığını araştırmanın önemini ortaya koymaktadır. Böyle bir araştırma Hume Yasası'nın çeşitli yorumlarını ve Hume Sınaması'nın çeşitli eleştirilerini göz önünde tutmalı, hukuk felsefesi kuramlarında ve tartışmalarında yer alan biçimiyle olandan olması gerekenin çıkarılamayacağı savının bu alan özelinde nasıl kavrandığını ortaya koymalıdır. Belirttiğimiz üzere, eldeki sorun Hume'un felsefesiyle sınırlı değildir. Ama bu durum, çalışmamızda Hume'un düşüncelerini incelemeye öncelik vermemiz önünde bir engel oluşturmaz. Çünkü Hume Yasası ve Hume Sınaması yaklaşımları, bir ölçüde Hume'un felsefesine değgin kavrayışlara dayanmaktadır. Bu nedenle çalışmamızda Hume'un felsefesini olabildiğince ilk elden ve doğrudan biçimde ele alarak özgün metinde olan-olması gereken ayrımının nasıl ele alındığını belirlemeye çalıştık. Bu yolda temel olarak çözümleyici bir yöntem benimsedik. Ancak sezgisel, eleştirel ve eytişimsel (dialectical) savlara ve açıklamalara başvurmamız gereğini duyduğumuzda bu yollardan ilerlemekten kaçınmadık. Bu doğrultuda Hume Çatalı ile Hume Yasası arasında epistemolojik anlamda kurduğumuz ilişki aracılığıyla her iki vargının kavranışında tartışmalı yönler bulunduğunu belirleyerek bu belirlemeleri hukuk felsefesi bakımından yaptığımız değerlendirmelere dayanak kıldık. Burada Hume Sınaması yorumlarının Hume'un felsefesine daha uygun düştüğü savının, en genel anlamda benimsediğimiz vargıların bütününü deyimlediğini söyleyebiliriz. Bunların ardından Hume Yasası'nın ve Hume Sınaması'nın hukuk felsefesindeki yansımalarının araştırılmasına ağırlık verdik. Hukuk felsefesi açısından temel savlarımız olarak ayrımın verili diye benimsendiği, hukuk kuramlarında temel ya da tutarlılık ölçütü olarak alındığı vargılarımızı ortaya koyduğumuz çalışmamızın kalanında eleştirel ve çözümleyici bir yöntem ile ilerledik. Böylece araştırmamızda daha önce ortaya koyduğumuz belirlemelerden yararlanmak ve hukuk felsefesinde olan-olması gereken sorununun kavranışına ışık tutmak olanağı bulduk. Araştırmamızda olan-olması gereken ayrımının verili sayılabilecek kadar kesin özellikte bir vargı belirtmediği, Hume'un felsefesi bağlamında ele alındığında bir Hume Yasası'ndan değil Hume Sınaması'ndan söz etmenin daha yerinde olacağı ve hukuk felsefesi kuramlarında olan-olması gereken ayrımına yüklenen önem ölçüsünde derinlikli bir kavrayışın bulunmadığı sonuçlarına vardık. Bu sonuçlar, olan-olması gereken sorunu bakımından yapılacak yeni çalışmalara ve yeni kuramsal yaklaşımlara gereksinim duyulduğunu göstermektedir. Bu türden yeni çalışmaların hukuk felsefesi kuramlarında erişilebilecek yeni ufukların yolunu açacağını umuyoruz.

David Hume is considered as one of the most important and influential thinkers of the Enlightenment by most philosophers and scientists. Reason for this overwhelming accord over his importance and influence, lies upon the revolutionary aspect of the new approaches that he brought to the empiricist philosophy. Hume's Fork, which states that the existence of a necessary connection between cause and effect cannot be proved rationally or empirically, is regarded as one of the philosopher's most important conclusions. In addition to this important contribution Hume made to epistemology, his conclusion that an“ought”cannot be derived from an“is”, known as Hume's Law, has been adopted as a principle to be kept in mind in every field of axiology, and other interpretations of this principle have been at the basis of some theories. This is also the case for the philosophy of law. Thus, it can be said that Hume's Law, which is also adopted as a basis or a criterion of consistency in the theories of legal philosophy, has a theoretical aspect worthy of attention. Various arguments have been put forward by contemporary philosophers against the assumption that there is an unbridgeable gap between“is”and“ought”, or in another formulation between fact and value. The most well-known of these is the argument put forward by Alasdair Chalmers MacIntyre, which we call Hume's Challenge, coined by Hsueh Qu. According to this, Hume did not argue that it is impossible to derive an“ought”from an“is”. In fact, for MacIntyre, who gives examples of the philosopher making such a transition in his own philosophy, what Hume reveals is not the impossibility but the difficulty of the transition from“is”to“ought”. As a result of the debates that emerged after the postulation of this argument, it was revealed that Hume's Law was not a principle as firm as hitherto thought. Nevertheless, in contemporary legal philosophy, Hume's Law is almost taken as“given”and is generally put forward and regarded in theoretical discussions as criterion of consistency. This situation gives rise to problems we aim to focus on in this study, and reveals the importance of investigating how the separation of“is”and“ought”, as a principle that Hume puts forward in his philosophy, is understood in the philosophy of law. Such research should take into account numerous interpretations of Hume's Law and various criticisms of Hume's Challenge, and should reveal how the argument an“is”cannot be derived from an“ought”appears in the theories and debates in the philosophy of law. As we have mentioned, the problem at hand is not limited to Hume's philosophy. However, this does not prevent us from giving priority to the study of Hume's thought as a basis in our study. For the approaches of Hume's Law and Hume's Challlange are, to some extent, based on insights from Hume's philosophy. Thus, in our study, we have tried to determine how the distinction between“is”and“ought”is considered in the original text by addressing Hume's philosophy in first-hand and as directly as possible. In this approach, we have basically adopted an analytical method. However, when we felt the need to resort to intuitive, critical and dialectical arguments and explanations, we did not refrain from them. Through these methods, we have suggested that there are controversial aspects in the epistemological relationship between Hume's Fork and Hume's Law, and that there are inconsistent aspects in the comprehension of both conclusions, and we have took these determinations as the basis of our evaluations in our investigation into the philosophy of law. Here, we concluded that the interpretation we called as Hume's Challange after Qu, is more appropriate to Hume's philosophy than what is generally known as Hume's Law interpretation. Following these, we concentrated on investigating the repercussions of Hume's Law and Hume's Challange in the philosophy of law. For the remainder of our study, we have put forward our first thesis that the distinction is adopted as a given in legal philosophy. We then proceeded within a critical and analytical framework and also considered approaches taking the distinction as the basis or validity criterion in legal theories. This has allowed us to shed light on the understanding of the problem in the philosophy of law. Although we tried to encompass most of the debate around Hume's Law and Hume's challenge, there being myriads of interpretations compelled us to confine ourselves to the well-known approaches. Even after we decimated our interest to a small number of philosophers and their theories, extensive and detailed philosophical background of the theories we chose to pursue prevented us from further penetrating into their intricacies. This stance of ours also holds true for the interpretations of Hume's philosophy in general which we only tangentially mentioned, both because of the limitations of our study and the goal of our interpretation of Hume's philosophy being acquiring the tools to investigate is-ought problem in his philosophical system. Similar limitations had to be considered also in our approach to the theories we chose peruse in our exploration in the philosophy of law. This had led us to trying to give balanced but somewhat in-depth account of the theories we mentioned in chapters where we tried to provide satisfactory answers to the fundamental questions of our research, i.e. is it justified to take is-ought distinction as a basic principle that entire theoretical approaches can be found upon and/or is it reasonable to dismiss theories or deem them incorrect if they do not meet with the criterion this distinction brought forward? We have concluded that the is-ought distinction does not denote a conclusion definite enough to be considered as“given”, especially in the philosophy of law. From this, it follows that it would be more appropriate to speak of a Hume's Challenge rather than a Hume's Law, when we consider the context in which Hume put forward the distinction in his philosophical system. We also conclude that the importance attached to the is-ought distinction is not mirrored by a depth of understanding in the philosophy of law theories subscribing to this distinction. In our opinion, these conclusions show that there is a need for new studies and new theoretical approaches in terms of the is-ought problem. We hope that such new studies will pave the way for new avenues to be explored within the theories and horizons of philosophy of law.
