Özet
Her hukuki varlık kaçınılmaz olarak soyuttur. Söz konusu soyut varlıklar köklerini somut olgulara dayandırmaktadır. Hukuki bir varlık olarak devletin ne olduğu meselesi de sosyolojik, psikolojik ve ekonomik kökleriyle ilgilidir. Bir başka deyişle devleti hukuki olarak tanımlamak; mezkur köklerin de anlaşılmasıyla mümkündür. Bağlı olarak bu köklerdeki değişimler de devlet ve hukuk açısından dramatik krizler ve değişimleri işaret etmektedir. Çalışmada öncelikle köken olarak ifade edilen alanlar ele alınmıştır. İnsan unsuru bu minvalde bireysel ve psikolojik varlığıyla ele alınırken akabinde tarihi ve sosyolojik bir okumadan istifade edilerek modern devletin nasıl inşa edildiği tartışılmıştır. Bu kapsamda yalnızca modern devletin inşa süreci değil aynı zamanda modern devletin mevcut olduğu süreçte meydana gelen değişim ve dönüşümler de ele alınmıştır. Böylelikle tezin temel argümanı olan modern devlet ve hukuk paradigmasının aşınarak geçerliliğini yitirdiği hususunun olgusal zemini kurulmuştur. Akabinde hukuki bir varlık olarak modern devlet, modern devletin son safhaları ve günümüzdeki durumu ifade ettiği düşünülen teknofeodalizm kavramına yer verilerek modern devlet ile hukuk paradigmasının aşınarak geçerliliğini yitirdiği hususu vurgulanmışıtr. Netice itibariyle temel argümanımız tez sathında vatandaşlık, kamu düzeni, devletin unsurları ve sözleşmeler gibi hususlar üzerinden test edilerek sunulmuştur. Çalışma sonucunda modern devletin ve hukukun aşındığı bir durumda insan tekinin de son derece olumsuz etkilendiği ve insana yakışır bir hayatın gittikçe imkansızlaştığı görülmüştür. Bu doğrultuda devletin modern karakterinin korunmasının insan tekinin olumsuz etkilerden korunması için de bir zaruriyet teşkil ettiği ve birey-devlet dikotomisinin günümüz itibariyle anlamsız olduğu; bunun yerine birey ile devletin birlikte varlığının mecburi olduğu ifade edilmiştir.

Every legal entity is inevitably abstract. These abstract entities derive their roots from concrete phenomena. The question of what the state is, as a legal entity, is inextricably linked to its sociological, psychological, and economic foundations. In other words, defining the state legally is only possible through an understanding of these aforementioned roots. Consequently, shifts within these foundations signal dramatic crises and transformations for both the state and the law. This study primarily examines the domains identified as these foundational origins. In this context, while the human element is analyzed through its individual and psychological existence, the construction of the modern state is subsequently discussed by utilizing a historical and sociological reading. Within this framework, not only the construction process of the modern state but also the changes and transformations occurring during its existence are addressed. Thus, the factual basis for the thesis's central argument—that the modern state and the legal paradigm are eroding and losing their validity—is established. Subsequently, by incorporating the concept of technofeodalism, which is considered to represent the modern state as a legal entity, its final stages, and its current condition, the erosion and loss of validity of the modern state and the legal paradigm are emphasized. Ultimately, our core argument is tested and presented throughout the thesis via issues such as citizenship, public order, the elements of the state, and contracts. The study concludes that in a situation where the modern state and law are eroded, the individual is also severely adversely affected, and a life worthy of human dignity becomes increasingly impossible. Accordingly, it is stated that preserving the modern character of the state is a necessity for protecting the individual from negative impacts; furthermore, the individual-state dichotomy is rendered meaningless today, as the co-existence of the individual and the state is now a structural imperative.
