Özet

ÖZ (ABSTRACT) Bu çalışmada, Avrupa Birliğinde telekomünikasyon sektörünün liberalizasyon süreci, gerek ardında yatan temel dinamikler, gerekse sonuçlan açısından incelenmeye çalışılmıştır. Çalışmayı hazırlarken, bu konuda yazılmış kitap, makale ve raporların yanında, İnternet'ten elde edilen kaynaklardan yararlanılmış; sektörle ilgili Komisyon kararlan, ATM kararlan ve Topluluk mevzuatı incelenmiştir. Avrupa Birliğinde telekomünikasyon sektörüne ilişkin geniş kapsamlı liberalizasyon politikasının oluşumu üç faktöre bağlanabilir. Telekomünikasyon şebekelerinin sayısallaşmasımn bir sonucu olarak sektörde doğal tekel ve devlet tekeli kavranılan sorgulanmaya başlanmıştır. Gerek Avrupa dışında bir örnek olarak ABD telekomünikasyon sektöründeki gelişmeler, gerekse İngiltere'de telekomünikasyon sekörünün liberalizasyonu adma yaşanan kaydadeğer gelişmeler, Komisyon'un liberalizasyon hedefleri içeren 1987 tarihli Telekomünikasyon Yeşil Kitabının hazırlayıcısı olmuştur. British Telecommunications ve özellikle Terminal Cihazlan kararlanyla, Avrupa Topluluktan Mahkemesinin telekomünikasyon sektörüne rekabet kurallanm uygulayarak liberalizasyon sürecini hızlandırmıştır. In this dissertation, It is aimed both to examine the liberalisation process of European Union telecommunication sector and to explore basic dynamics which lie behind liberalisation process and the effects of process on competition. Some books, articles, reports related to telecommunications sector and the sources which were accessed via Internet have been referred to in the preparation of this dissertation. Besides, Community legislation, Commission's decisions and Court's case law have been reviewed.EU telecommunications policy developed rapidly, mainly as a consequence of three factors: -As a result of the growing digitisation of the European telecommunications networks, the national and natural monopoly concepts in the telecommunications sector started to be questioned in most EU Member States. -The impact of the AT&T divestiture agreement and the resulting transformation of the US market began to be felt in Europe. At the same time, progressive deregulation of the sector and the privatisation of BT in the United Kingdom since 1982 had made Europe more receptive to the concept of market deregulation. The combination of these factors resulted in the issuing by the Commission of the 1987 Telecommunications Green Paper which set for the first time a comprehensive policy framework for EU action in the telecommunications sector. - In British Telecommunications, the Court of Justice confirmed that EU competition rules applied to the sector. And Terminal Equipment decision accelerated liberalisation process. Ill
